Article 38 PDPA
Immunity of the President of the Office
1. The President of the Office may not be held criminally liable or deprived of liberty without the prior consent of the Diet of the Republic of Poland.
2. The President of the Office may agree to prosecute him for the offenses referred to in paragraph (3) in accordance with the procedure set forth in this provision.
3. If the President of the Office commits an offense referred to in Chapter XI of the Act of May 20, 1971. - Misdemeanor Code (Journal of Laws of 2018, item 618 and 911), acceptance by the President of the Office of a criminal fine or payment of a fine, in the case of punishment by a criminal fine in absentia, as referred to in Article 98 § 1 item 3 of the Act of August 24, 2001. - Code of Conduct in Offense Cases (Journal of Laws of 2018, item 475), shall constitute a statement of his consent to be held liable in this form.
4. The President of the Office may not be detained or arrested, except when apprehended in the commission of a crime and if his detention is necessary to ensure the proper course of the proceedings. The Speaker of the Diet shall be immediately notified of the detention, who may order the immediate release of the detainee.
