UODO inspection. Ready?

Organisations that are confident they comply with GDPR genuinely reduce the risk of legal violations and resulting sanctions, including financial penalties and reputational harm.

UODO inspection – effective risk reduction

The President of the Personal Data Protection Office has full authority to supervise organisations and enforce GDPR rules. Many companies fear sector UODO inspections and the serious consequences they may bring.

Instead of avoiding confrontation, you can prepare your company for any eventuality. Verify that your organisation meets all GDPR obligations and that no rules are breached. That is the best way to take the fear out of inspections and gain knowledge that protects against unnecessary costs. As part of UODO inspection preparation we carry out an IT systems audit and a legal audit of personal data processing in the part of your organisation that will be inspected.

Preparing for an inspection by the Personal Data Protection Office

As part of UODO inspection preparation we carry out an IT systems audit and a legal audit of personal data processing in the part of your organisation that will be inspected.

Inspection proceedings

For many organisations this is a critical moment. We know it is stressful, especially for staff who may be interviewed as witnesses to establish the facts.

That is why our support does not end when the inspection begins. Experienced lawyers can also take part as representatives of the inspected organisation, so you can be confident the process is conducted correctly.

Our specialists also provide real support to your organisation's staff, including verifying information shared with authorised office employees while respecting trade secrets.

Good to know

Identifying procedural breaches of data protection law during an inspection can be crucial if you need to appeal the UODO President's decision to the Voivodeship Administrative Court.

Hiding your head in the sand won't help!
With us, inspections don't hurt

Let us review your situation and prepare your organisation for any eventuality. With us, a UODO inspection is just a formality.

Court and administrative proceedings

Organisations subject to proceedings do not have to accept the administrative decision. However, if they wish to exercise their right, they must file a complaint with the Voivodeship Administrative Court within 30 days of receiving the decision.

We therefore support our clients in filing complaints with the Voivodeship Administrative Court and cassation appeals with the Supreme Administrative Court.

I am very impressed with the high level of substantive expertise of the training staff"

From 13 to 17 March I attended the "Course for Information Security Administrators" organized by ODO 24 sp. z o.o. I am very impressed with the high substantive level of the training staff and the comprehensive program. Working as an ABI requires knowledge not only of legal provisions but also of IT matters, which ODO 24 took into account. Noteworthy is the curriculum, which gradually introduces increasingly advanced nuances of personal data protection, starting from the legal basics and ending with practical aspects of auditing and working with documents within a company. The complete set of materials, editable documents and publications I received will facilitate my daily work as an ABI. I can certainly recommend ODO 24 as a reliable partner offering training services of a high standard.

We can wholeheartedly recommend ODO 24 as a professional and reliable partner"

For many years we have consistently placed great importance on the protection of the personal data of our customers as well as our employees. We took an active part in creating the "Code of Good Practice for the Protection of Personal Data of Customers and Potential Customers,” developed jointly by GIODO and the Polish Automotive Industry Association. Due to the complexity and variability of the rules on personal data protection, as well as Mazda’s dynamic development in Poland and the increasing volume of data we process, we decided to entrust the ABI function to a company specialized in this field. The decision to use the services of ODO 24 was primarily influenced by the experience and competence of the team of experts, the comprehensiveness of the offering and its flexibility in adapting to our organization. After a year of cooperation we can recommend ODO 24 as a professional and reliable partner.

A practical approach, continuous advisory availability, and positive working relationships"

We have been working with ODO24 for over a year. For us it has been a year of peaceful breathing and a sense of security: at least regarding personal data protection :-) The people at ODO are professionals who explain matters that are incomprehensible to the average person in an understandable way. They understand not only their profession but, which is very important to us, business and its requirements. A practical approach, constant advisory availability, and great relationships — all of this means I can recommend this Company to anyone who wants to work and sleep peacefully.

I highly recommend ODO 24 as a professional partner delivering services at the highest level.

UODO inspection questions and answers

How long does a UODO inspection take?

An inspection by the Office for Personal Data Protection (UODO) in Poland can last for varying periods, depending on many factors, such as the complexity of the case, the scope of data processed, and the level of cooperation of the inspected company with the authority. There is no fixed, strictly defined duration for an inspection. In some cases an inspection may take a few days, while in others it may be extended to several months.

Moreover, the inspection process may consist of various stages, including:

  • Preparation for the inspection: UODO may request the submission of necessary documents and information prior to the start of the inspection.
  • Execution of the inspection: This phase may include visits to the company’s premises, review of documentation, interviews with employees, etc.
  • Post-inspection proceedings: After the inspection, UODO analyses the collected information and may take appropriate actions, e.g. issue recommendations, impose sanctions, etc.

It is advisable to be aware that effective cooperation with UODO and proper preparation for the inspection can contribute to its smoother execution.

How long does the process of preparing for a UODO inspection take?

Preparation for a UODO inspection can take from several weeks to several months. It is important to remember that thorough and detailed preparation is an investment in long-term security and compliance with data protection regulations.

Here are some key aspects that may affect the duration of preparations:

Size and complexity of the organisation Large companies with extensive data processing systems may require more time for audit and preparation than smaller organisations.

Current state of compliance with RODO If the company has previously paid attention to RODO compliance, preparations may be faster. Conversely, companies with larger deficiencies in this area may need more time to adapt to the requirements.

Scope of the audit An IT and legal audit may be more or less detailed, depending on the needs and specificities of the organisation.

Availability of resources The speed of preparations may also depend on the availability of company staff and resources necessary to carry out the audit and implement changes.

Do you guarantee that my company will pass a UODO inspection without any reservations?

As ODO 24, we make every effort to prepare an organisation for a UODO inspection in the most comprehensive way. Our IT and legal audit aims to accurately identify areas requiring attention and to ensure compliance with RODO.

However, it is important to understand that each UODO inspection is unique and depends on many factors. We therefore cannot guarantee that the inspection will proceed without any reservations whatsoever, as the final assessment rests with the UODO inspectors.

What we can guarantee is minimising the risk of potential irregularities, our full commitment and experience in thoroughly preparing the company for an inspection. We provide best practices and procedures that will not only help to pass a UODO inspection but also strengthen the organisation’s overall data protection processes.

Do you provide legal support during the UODO inspection itself?

Yes, we provide legal support during the UODO inspection itself. We recognise that a UODO inspection can be a stressful and demanding process, which is why we ensure the presence of experienced advocates or legal advisers who will act as your authorised representatives.

Our support also includes the protection of trade secrets and the identification of any shortcomings, which may be crucial if it becomes necessary to file a complaint against the decision issued by the President of UODO with the Provincial Administrative Court.

Our aim is to provide you with comprehensive legal assistance that will enable you to undergo the UODO inspection with greater calm and confidence.
