General conditions for the members of the supervisory authority
P: 121
1. Member States shall ensure that each member of their supervisory bodies is appointed through a transparent procedure by:
- their parliament,
- their government,
- their head of state, or
- independent body authorized to appoint members of the supervisory authority under the laws of a member state.
2. Each member must have the qualifications, experience and skills - particularly in the field of data protection - needed to fulfill their duties and exercise their authority.
3. In the event of the expiration of the term of office, resignation or involuntary disqualification, a member of the body shall cease to perform his duties in accordance with the laws of the relevant member state.
4. A member may be removed from office only if he or she has committed serious misconduct or no longer meets the conditions necessary to perform his or her duties.
