(121) The general conditions for serving as a member of the supervisory authority should be determined by the law of each Member State and should, in particular, ensure that the members of the authority are appointed using a procedure that ensures transparency by the parliament, the government or the head of the Member State concerned - on the proposal of the government, a member of the government, the parliament or a chamber of the parliament - or by an independent body entrusted with this task by the law of the Member State. To ensure the independence of the supervisory body, its member(s) should act with integrity, refrain from any activity incompatible with their duties, and should not, during their term of office, engage in any gainful or nonprofit activity incompatible with those duties. The supervisory body should have its own staff, which shall be selected by this supervisory body or an independent body established under the laws of a Member State, and should act under the sole direction of the member or members of this supervisory body.
