Independence

1. Each supervisory authority, in carrying out its tasks and exercising its powers in accordance with this Regulation, shall act in a fully independent manner.
2. The member or members of each supervisory authority, when performing their tasks and exercising their powers in accordance with this Regulation, shall remain free from direct and indirect external influences and shall neither seek nor receive instructions from anyone.
3. A member or members of each supervisory body shall refrain from any activity incompatible with their duties and shall not engage in any gainful or nonprofit activity incompatible with those duties during their term of office.
4. Each Member State shall ensure that each supervisory authority has the human, technical and financial resources, premises and infrastructure necessary to effectively carry out its tasks and exercise its powers, including mutual assistance, cooperation and participation in the work of the European Data Protection Board.
5. Each Member State shall ensure that each supervisory authority selects and has its own staff, acting under the sole direction of the member or members of the supervisory authority concerned.
6. Each member state shall ensure that each supervisory body is subject to financial control in a manner that does not compromise its independence and has a separate public annual budget, which may be part of the general state or national budget.
