For how long after termination of the contract may the personal data of a person engaged under an agency contract be processed?
ANSWER
The rules on the retention period for employee documentation set out in the Act of 10 January 2018 amending certain acts in connection with shortening the retention period for employee files and their digitisation apply accordingly to employment on the basis of a contract of mandate, an agency contract and other service contracts. Consequently, from 1 January 2019, this is a period of 10 years, counted from the end of the calendar year in which the employment relationship ended or the contract terminated.
