Can merely possessing software that allows central management of computers be treated as having the capacity to monitor?

ANSWER

Merely possessing such software may (depending on its specific features) mean having the capacity to monitor, but it does not appear to determine that monitoring is in fact applied — for that to occur, the system would still need to be appropriately configured.
