Article 98 PDPA
Initiation of legal proceedings by the President of the Authority; participation of the President of the Authority in legal proceedings

1. In cases involving claims for violations of data protection laws, which can only be asserted in court, the President of the Office may bring actions on behalf of the data subject with his consent, and may also enter, with the consent of the plaintiff, into the proceedings at any stage of the proceedings.

2. In other cases involving claims for violations of data protection laws, the President of the Office may enter, with the consent of the plaintiff, into the proceedings before the court at any stage of the proceedings, unless there are proceedings pending before it concerning the same violation of data protection laws.

3. In the cases referred to in paragraphs 1 and 2, the provisions of the Act of November 17, 1964 shall apply to the President of the Office accordingly. - Code of Civil Procedure (Journal of Laws of 2018, item 155, as amended) on the prosecutor.
