
Article 84 PDPA
Powers of the controller
1. The inspector has the right:
1) access from 6:00 a.m. to 10:00 p.m. to the land and to buildings, premises or other premises;
2) inspect documents and information directly related to the scope of the subject matter of the audit;
3) conduct visual inspections of sites, objects, devices, media and information or data processing systems;
4) demand written or oral explanations and question persons as witnesses to the extent necessary to establish the facts;
5) commission the preparation of expert reports and opinions.
2. The inspected person shall provide the inspector and persons authorized to participate in the inspection with the conditions and means necessary for the efficient conduct of the inspection, and in particular shall make copies or printouts of the documents and information collected on the media, devices or systems referred to in paragraph 1 item 3 on their own.
3. The inspected person shall certify as true to the original the copies or printouts made, referred to in paragraph 2. In the event of refusal to certify as true to the original, the inspector shall make a note of this in the inspection protocol.
4. In justified cases, the course of the inspection or individual activities during the course of the inspection, after informing the inspected person in advance, may be recorded by means of image or sound recording devices. Computer data carriers within the meaning of the Act of February 17, 2005 on the computerization of the activities of entities performing public tasks (Journal of Laws of 2017, item 570 and of 2018, item 1000), on which the course of the inspection or individual activities in its course were recorded, shall be an attachment to the inspection protocol.
