Article 149 PDPA

The Act of 28 January 2016 Law on the Public Prosecutor's Office (OJ 2017 L 1767 and L 5 of 2018) is amended as follows:

1) w art. 13:

(a) Paragraph 5 is replaced by the following: § 5. The National Prosecutor's Office is the administrator of data processed in the national telecommunications systems of the general organisational units of the Prosecutor's Office.,

(b) § 6 and 7 shall be added in the following wording: "§ 6. The general organizational units of the public prosecutor's office shall be the controllers of the data processed within the framework of the tasks performed, with the exception of the data referred to in § 5. § 7. For the processing of personal data in proceedings or ICT systems within the framework of the performance of the tasks referred to in Article 2, the provisions of Articles 12-16, Art. 18-22 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119 of 04.05.2016, p. 1) shall not apply.";

2) in Article 191, § 2 shall be repealed
