Article 102 PDPA
Impose an administrative penalty on public finance sector entities, research institutes or NBPs

1. The President of the Office may impose, by decision, administrative fines of up to PLN 100,000, on:

1) units of the public finance sector, referred to in Article 9 points 1-12 and 14 of the Law of August 27, 2009 on public finance;

2) research institute;

3) National Bank of Poland.

2. The President of the Office may impose, by decision, administrative fines of up to PLN 10,000 on units of the public finance sector, as referred to in Article 9(13) of the Public Finance Act of August 27, 2009.

3. Administrative fines referred to in paragraphs 1 and 2 shall be imposed by the President of the Office on the basis and under the conditions set forth in Article 83 of Regulation 2016/679.
