Suspension of the proceedings
P: 144
1. If the competent court of a Member State has information that there are proceedings pending before a court in another Member State on the same matter with respect to processing by the same controller or the same processor, it shall contact the court in the other Member State to confirm the existence of such proceedings.
2. If proceedings are pending before a court in another member state on the same matter with respect to processing by the same controller or the same processor, a competent court other than the court before which the proceedings were first brought may suspend its proceedings.
3. If these proceedings are pending at first instance, a court other than the court before which the proceedings were first instituted may also, at the request of one of the parties, declare that it lacks jurisdiction, if the court before which the proceedings were first instituted has jurisdiction over the cases in question and its law allows them to be joined.
