Conditions for giving consent

1. If the processing is based on consent, the controller must be able to demonstrate that the data subject has consented to the processing of his or her personal data.

2. If the data subject gives his or her consent in a written statement that also concerns other matters, the request for consent must be presented in a manner that makes it clearly distinguishable from the other matters, in an understandable and easily accessible form, in clear and simple language. The part of such statement of the data subject in violation of this Regulation shall not be binding.

3. The data subject has the right to withdraw consent at any time. The withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. The data subject shall be informed of this before giving consent. Withdrawal of consent must be as easy as giving it.
4. In assessing whether consent has been given voluntarily, the greatest possible consideration shall be given to whether, among other things, the performance of a contract, including the provision of a service, depends on consent to data processing, if the processing of personal data is not necessary for the performance of that contract.
