Recital 142

(142) If a data subject believes that his or her rights under this Regulation are being violated, he or she should have the right to instruct an entity, organization or association - which is not for profit, has been established in accordance with the law of a Member State, has a statutory objective of public interest and is active in the field of personal data protection - to lodge a complaint on his or her behalf with the supervisory authority, to exercise the right to an effective remedy before a court on behalf of data subjects, or, insofar as this possibility is provided for by the law of a Member State, to claim compensation on behalf of data subjects. A Member State may require that such entity, such organization or such association, regardless of the order received from the data subject, have the right to lodge a complaint in that Member State and have the right to an effective remedy before a court if they have reason to believe that the rights of the data subject have been violated as a result of the processing of personal data in violation of this Regulation. Such entity, such organization or such association may not have the right to seek redress on behalf of the data subject if they have not been authorized to do so by the data subject.
