Recital 141

(141) Every data subject should have the right to lodge a complaint with a single supervisory authority and the right to an effective remedy before a court, in accordance with Article 47 of the Charter of Fundamental Rights, in particular in the Member State in which he or she has his or her habitual residence, and if he or she considers that his or her rights under this Regulation are being violated, or if the supervisory authority does not respond to the complaint, dismisses or rejects it in part or in whole, or fails to act, although this is necessary to protect the person's rights. The investigation on the basis of a complaint should be conducted - subject to judicial review - to the extent appropriate to the specific case. The supervisory authority should, within a reasonable time, inform the data subject of the progress and results of the complaint investigation. If a case requires further investigation or coordination with another supervisory authority, the data subject should be informed in advance. To facilitate the filing of complaints, each supervisory authority should take such measures as providing a complaint form that can also be filled out electronically, while not excluding other means of communication.
