Recital 136

(136) As part of the application of the consistency mechanism, the European Data Protection Board should issue opinions within a certain timeframe if so decided by a majority of its members or if so requested by the supervisory authority concerned or the Commission. The European Data Protection Board should also be empowered to adopt legally binding decisions in the event of disputes between supervisory authorities. To that end, it should issue, in principle by a two-thirds majority of its members, legally binding decisions in clearly defined cases where there are conflicting opinions among the supervisory authorities - in particular under the cooperation mechanism between the lead supervisory authority and the supervisory authorities concerned - on the merits of the case, in particular whether there has been a violation of this Regulation.
