Recital 115

(115) Some third countries adopt laws, regulations and other acts to directly regulate processing activities undertaken by natural and legal persons under the jurisdiction of member states. This may include judgments of courts or tribunals or decisions of administrative authorities of a third country ordering a controller or processor to transfer or disclose personal data that do not have as their basis an international agreement - for example, a mutual legal assistance agreement - in force between the requesting third country and the Union or a Member State. Cross-border application of these laws, regulations and other acts may violate international law and make it impossible to provide individuals with the protection provided by this Regulation by the Union. Transfers should be permitted only in cases where the conditions for transfers to third countries established by this Regulation are met. This may be the case, among others, where disclosure is necessary for important public interests recognized in Union law or in the law of the Member State to which the controller is subject
