Will the deadline for notifying PUODO of a breach (72 hours) be counted from the date of the postal stamp?

ANSWER

PUODO operates on the basis of administrative procedure provisions. The legal provisions indicating that a deadline for performing an act is met by submitting documents at a post office are Article 57(5)(2) of the Code of Administrative Procedure: "A deadline shall be deemed to have been met if, before its expiry, the document was: (2) submitted at a Polish post office of a designated operator within the meaning of the Act of 23 November 2012 – Postal Law, or at a post office of an operator providing universal postal services in another Member State of the European Union, the Swiss Confederation, or a Member State of the European Free Trade Association (EFTA) that is a party to the Agreement on the European Economic Area."
