When CCTV is used only outside the building, do all the discussed established requirements apply, e.g. provisions in the work regulations, notification, etc.?
ANSWER
If you use monitoring only outside the building (entrances, driveways, etc.), as a rule it falls within the concept of visual monitoring under Article 22² of the Labour Code. Under that provision, where it is necessary for the purposes described in that article, the employer may introduce special supervision over the workplace premises (understood as the area together with buildings at the employer's disposal where the employer organises workstations) or the area around the workplace, by means of technical measures enabling image recording.
