Can the police, citing ongoing proceedings and Article 15(2) of the Code of Criminal Procedure and Article 15(6) of the Police Act, require an employer to provide an authenticated copy of employee documentation in connection with a workplace accident?

ANSWER

The legal bases cited by the Police — Article 15(2) of the Code of Criminal Procedure and Article 15(6) of the Police Act — authorise the Police to request the documentation indicated in connection with accident-related proceedings. If the request contains the legal basis cited and information about the proceedings to which the documents containing personal data are to relate, the controller is entitled to disclose such personal data at the request of law enforcement authorities. In that case, disclosure will not breach personal data protection provisions.
