Can cameras be installed in a canteen that employees do not use?

ANSWER

As a rule, an employee canteen is subject to a ban on monitoring, unless the use of monitoring in that room is necessary to achieve a purpose such as ensuring employee safety, protecting property, production control, or keeping confidential information secret where its disclosure could harm the employer, and at the same time it does not violate the employee's dignity and other personal rights (pursuant to Article 22² § 2 of the Labour Code). Assuming that employees do not use the canteen, we may accept that their dignity and other personal rights will not be threatened by monitoring in that room; however, the question arises as to how the room in question is currently used and whether its monitoring is in fact necessary for the purposes mentioned above.
