Should information about log monitoring be included in the work regulations?

ANSWER

Yes. Information on the purposes, scope, and methods of monitoring should be included in the work regulations or, where the employer is not covered by a collective labour agreement and is not required to establish work regulations, in a notice.

Independently of the above obligation, Art. 22² § 9 of the Labour Code requires the monitored premises and area to be marked in a visible and legible manner, using appropriate signs or audible announcements, no later than one day before monitoring commences. The tool subject to that form of monitoring (the IT environment or IT system) should be marked accordingly.
