Recital 145

(145) In the case of proceedings against an administrator or processor, the complainant should be able to choose to which court he wishes to lodge a complaint: to a court in a Member State where the administrator or processor has an organisational unit or to a court in a Member State where the data subject is domiciled, provided that the administrator is not a public authority of a Member State acting in the exercise of its public powers.
