Recital 105

(105) In addition to the international obligations of a third country or international organization, the Commission should take into account the obligations arising from the participation of a third country or international organization in multilateral or regional regimes, particularly with regard to the protection of personal data, and the implementation of such obligations. In particular, it should take into account the accession of the third country to the Council of Europe Convention of January 28, 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data. In assessing the degree of protection in third countries or international organizations, the Commission should consult the European Data Protection Board.
