GDPR: experience in media and marketing

The media and marketing industry relies on intensive processing of personal data – from email addresses and demographic data to information about user behaviour online. In the context of the GDPR, the challenge is not only to obtain marketing consent, but also documenting its source, controlling data retention and transparency of profiling mechanisms used. Large agencies and publishers simultaneously run many campaigns and analytical tools at once, which makes it easy to lose control over the scope of the information processed or inconsistencies in communication with recipients.

ODO 24 implemented GDPR solutions for advertising agencies, media houses and online publishers. As part of the projects carried out, we updated privacy policies and marketing consent mechanisms (including in CRM, mailing and e-commerce systems),we developed communication templates meeting GDPR requirements and conducted training for creative, sales and IT departments. As a result, our clients regained control over data processing, reduced the risk of complaints to the supervisory authority and strengthened trust in relationships with users and advertising partners.

How much do GDPR services cost for the media and marketing sector?

The cost depends on the scale of data processing, the number of communication channels and the tools used for campaigns. We offer packages including audits, adaptation of privacy policies, consent mechanisms and agreements with partners. We prepare quotes individually – including for agencies, publishers and media houses.

What GDPR problems most commonly occur in media and marketing?

The most common are lack of GDPR-compliant marketing consents, improper use of cookies and non-transparent communication with the user. Also problematic are undocumented data processing arrangements and a lack of clarity about who in the project is responsible for the data.

Do I need consent for every mailing or remarketing campaign?

Yes – every form of marketing contact requires an appropriate legal basis, and often also the active consent of the recipient. We help set up a consent system and its recording, including within mailing tools and CRM.

Which data are most at risk in marketing activities?

Contact, behavioural, location and demographic data, as well as profiles created on the basis of user activity. The risk increases when using multiple systems and advertising tools without a coherent data management policy.

Does the GDPR also apply to data collected by advertising campaigns on social media?

Yes – data collected via lead forms, pixels and other tracking tools are also subject to the GDPR. You must ensure appropriate legal bases, information for the user and suitable relationships with partners (e.g. Facebook, Google).

Won't the implementation of the GDPR slow down campaigns or the agency's daily work?

No – we implement solutions that integrate with current tools and processes. We work so that the GDPR supports transparency and professionalism, rather than limiting creativity.
