The municipal utilities and technical infrastructure sector processes the data of millions of residents in the provision of essential services: water, sewerage, waste collection, transport or thermal energy. From a GDPR perspective, the problem is not just documentation obligations, but the lack of standardised procedures and low incident resilience of systems. ODO 24 has implemented solutions for municipal companies and technical infrastructure operators across Poland. As part of the projects, we prepared GDPR compliance audits, updated entitlement management policies, standardised templates for data processing agreements and provided training for technical, legal and IT departments. We also helped implement incident response policies and adapt billing systems to current legal requirements. As a result, organisations gained greater transparency in data management and reduced information security risks in public services.

Digital systems for managing water supply, district heating, waste management or road infrastructure process huge amounts of data and are an essential part of how cities and municipalities function. This requires not only GDPR compliance, but also a high level of resilience against cyber threats.
The NIS2 directive classifies many entities in the utilities sector as critical or important. This brings with it the obligation to implement comprehensive security policies, risk management and effective incident response. Integrating the requirements of the GDPR and NIS2 is not just a regulatory requirement today – it is the foundation for protecting residents' data, continuity of service delivery and the technical resilience of utility systems against disruption and digital attacks.

GDPR in public administration and public services – questions and answers
The cost depends on the size of the unit, the type of services provided (e.g. water, waste, heat) and the level of complexity of data processing. We offer flexible packages for municipal companies, technical operators and public utilities. We prepare individual quotations taking the unit's budget into account.
The most common are a lack of consistent rules for entrusting data to subcontractors, outdated billing systems and lack of control over user permissions. Out-of-date records of processing activities and lack of incident response procedures also frequently occur.
Yes – the majority of entities providing public services are obliged to appoint a Data Protection Officer (DPO). We offer an external DPO service including ongoing support and representation before the supervisory authority.
Personal customers' data require special protection, such as residential addresses, account numbers, billing data or information on service usage (e.g. utility consumption). High risk also pertains to employee data – especially special-category data, e.g. health data – and to users of the infrastructure, such as location information originating from GPS systems, IoT or smart meters. Additional threats are associated with processing data from video surveillance systems, reporting platforms (e.g. faults, complaints) and inadequately secured integrations between operational systems and external entities (e.g. contractors, subcontractors, IT operators).
Yes – data transferred to external companies must be covered by a formal data processing agreement and processed in accordance with the GDPR. The absence of such safeguards may result in liability on the part of the operator.
